These Terms & Conditions (“Terms”) govern your use of services provided by Kinser Studios (“we,” “us,” or “our”) and your use of our website at https://kinserstudios.com (the “Site”). By booking our services or using our website, you agree to be bound by these Terms.

1. Services Provided

Kinser Studios is a professional photography business specializing in:

Photography Services:

• Business Headshots: Professional portraits for corporate use, LinkedIn profiles, websites, and marketing materials
• Actor Headshots: Specialized portraits for performers, agents, casting directors, and industry professionals
• Event Photography: Convention booth photography, corporate events, and live headshot sessions
• Group Headshots: Team photography, corporate groups, and organizational portraits
• Personal Branding: Lifestyle and professional imagery for entrepreneurs and personal brands

Service Areas:

• Primary service area: Salt Lake City, Utah and surrounding areas
• Travel services available for out-of-state events (additional fees apply)
• Studio sessions and on-location photography

2. Booking and Payment Terms

Booking Process:

• All sessions require advance booking and signed service agreement
• Free consultation calls available via Zoom to discuss project requirements
• Session dates are reserved upon receipt of signed contract and deposit
• Availability is confirmed only after contract execution

Payment Structure:

• Deposit: 50% deposit required to secure booking (non-refundable)
• Final Payment: Due before or at the time of session
• Accepted Methods: Credit/debit cards, bank transfers, check (with prior approval)
• Late Fees: 1.5% per month on overdue balances
• Travel Events: Full payment required 30 days before event date

3. Session Policies

Scheduling and Attendance:

• Clients must arrive on time for scheduled sessions
• Late arrivals may result in shortened session time without refund
• No-shows forfeit entire session fee and must reschedule with new deposit
• We reserve the right to reschedule due to illness, weather, or emergency

Session Preparation:

• Clients responsible for hair, makeup, and wardrobe unless otherwise arranged
• Styling guidance and preparation tips provided before session
• Multiple outfit changes encouraged for variety
• Props and special requests subject to advance approval

4. Cancellation and Rescheduling

Client Cancellations:

• 30+ days notice: Full refund minus $50 administrative fee
• 14-29 days notice: 50% refund of total session fee
• 7-13 days notice: 25% refund of total session fee
• Less than 7 days: No refund (deposit and payments forfeited)
• Same day: Full session fee charged

Rescheduling:

• One free reschedule allowed with 14+ days notice
• Additional rescheduling subject to $75 administrative fee
• Subject to photographer availability
• Weather-related rescheduling provided at no charge

Kinser Studios Cancellations:

• Full refund provided for cancellations on our part
• Alternative dates offered when possible
• Not liable for consequential damages or additional costs

5. Image Delivery and Usage Rights

Image Delivery:

• Turnaround Time: 2-3 weeks for edited images (rush delivery available for additional fee)
• Delivery Method: Secure online gallery with download access
• Image Quantity: As specified in service agreement (typically 5-25 edited images)
• Gallery Access: Available for 90 days from delivery date

Client Usage Rights:

• Personal and business use of delivered images as specified in agreement
• Print rights included for personal use
• Commercial usage rights vary by service package
• Credit to “Kinser Studios” appreciated but not required for personal use
• Modification and editing by client permitted

6. Model Release and Marketing Usage

Portfolio and Marketing Use:

• Separate model release required for any marketing or portfolio use
• Model release is OPTIONAL and not required for receiving your images
• Compensation or discounts may be offered for model release signing
• You may revoke marketing consent with 30 days written notice (applies to future use only)

Social Media and Website Use:

• With model release: Images may appear on our website, social media, advertising, and promotional materials
• Without model release: Images will not be used for any marketing purposes
• Behind-the-scenes content may be shared with subjects’ verbal consent

7. Equipment and Technical Issues

Equipment Failure:

• Backup equipment available for all critical components
• In case of major equipment failure, session will be rescheduled at no charge
• Not liable for delays or cancellations due to equipment failure beyond our control

Image Loss or Corruption:

• Multiple backup systems used to prevent image loss
• In rare case of image loss, replacement session provided at no charge
• Liability limited to session fee paid

8. Client Responsibilities

Preparation and Cooperation:

• Arrive prepared with appropriate wardrobe and grooming
• Cooperate with photographer’s direction for best results
• Provide accurate contact information and respond to communications
• Notify us of any special needs, medical conditions, or accessibility requirements

Event Photography:

• Provide event timeline, key contact information, and special requirements
• Ensure photographer has appropriate access and permissions
• Coordinate with venue staff as needed
• Provide parking and meal arrangements for long events

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KINSER STUDIOS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of business opportunities, reputation, or profits
• Damages resulting from circumstances beyond our reasonable control
• Issues with venue restrictions, lighting conditions, or interference
• Client’s failure to follow preparation guidelines or arrive as scheduled

TOTAL LIABILITY LIMITED TO: Amount paid for photography services. This limitation applies regardless of the cause of action.

10. Force Majeure

Neither party shall be liable for delays or failures due to circumstances beyond reasonable control, including:

• Natural disasters, severe weather conditions
• Government restrictions, public health emergencies
• Transportation disruptions, venue closures
• Serious illness or family emergency

11. Communication and TCPA Compliance

Appointment Reminders and Updates:

• SMS and email reminders sent for scheduled sessions
• Image delivery notifications and gallery access information
• Business updates and promotional messages (with separate consent)

Opt-Out Rights:

• Reply “STOP” to SMS messages to unsubscribe
• Use unsubscribe links in emails
• Contact us directly to update communication preferences

12. Intellectual Property

Copyright Ownership:

• Kinser Studios retains copyright to all photographs and creative work
• Clients receive usage rights as specified in service agreements
• Unauthorized reproduction or distribution prohibited
• Commercial licensing available for additional fee

Website and Brand Protection:

• All website content, logos, and branding protected by copyright and trademark law
• Unauthorized use of our brand, images, or content prohibited
• DMCA takedown procedures enforced for copyright violations

13. Dispute Resolution

Governing Law:

• These Terms governed by the laws of the State of Utah
• Disputes resolved in Salt Lake County, Utah courts
• Utah state law applies to all photography services and agreements

Resolution Process:

• Good faith negotiation required before formal legal action
• Mediation preferred for contractual disputes
• Attorney fees may be awarded to prevailing party

14. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for details about:

• Information collection and usage practices
• Image storage and sharing policies
• Communication preferences and opt-out rights
• Data security and retention policies

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be:

• Posted on our website with updated effective date
• Communicated via email for material changes
• Applied to future bookings (existing contracts governed by original terms)

16. Severability and Entire Agreement

• If any provision is unenforceable, remaining terms continue in effect
• These Terms, along with your service agreement, constitute the entire agreement
• Modifications must be in writing and signed by both parties
